Emergency Authorization

In the event of illness or injury, Starlight Equestrian Ranch is authorized to:
If owner cannot be reached, Ranch may secure veterinary care at owner’s expense.

Liability Acknowledgment

Owner acknowledges:
  • Horses are kept at owner’s risk
  • Ranch is not responsible for illness, injury, theft, escape, or death
  • Owner is responsible for insurance coverage on horse
  • Owner assumes all risks associated with boarding
Owner agrees to comply with Ranch rules and maintain respectful conduct.

Late Fee Policy: 10 Days grace period, after the 10th day the late fee is $50.00

Trail Riding Privileges

Boarder may ride on designated trails originating from or connected to the Ranch property.

Trail riding is a voluntary activity undertaken entirely at the Boarder's own risk.

Starlight Equestrian Inc. makes no representations, recommendations regarding trail conditions, weather conditions, wildlife, terrain, fences, obstacles, road crossings, other riders, livestock, or other hazards.

The Boarder assumes full responsibility for evaluating trail conditions before riding.

Release of Liability and Assumption of Risk

To the fullest extent permitted by law, the Boarder, on behalf of themselves, their family members, heirs, assigns, representatives, guests, and anyone acting on their behalf, hereby releases, waives, and discharges: Starlight Equestrian Ranch, Inc., its owners, officers, directors, employees, volunteers, agents, contractors, affiliates, sponsors, and property owners from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising from or related to:
  • Horse boarding
  • Riding activities
  • Trail riding
  • Horse handling
  • Ranch activities
  • Use of facilities
  • Interaction with horses, livestock, or other animals
This release includes claims based upon ordinary negligence but does not apply to gross negligence or willful misconduct.

California Equine Act Notice

Warning
Under California law, an equine activity sponsor or equine professional is not liable for an injury to or death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to California Civil Code Section 1812.

Indemnification

Boarder agrees to defend, indemnify, and hold harmless Starlight Equestrian Ranch Inc. from any claim, lawsuit, damage, injury, loss, cost, or expense arising out of:
  • The Boarder's horse
  • The Boarder's guests, invitees, family members, or agents
  • The Boarder's use of the Ranch facilities
  • Violation of Ranch policies
  • Including reasonable attorney fees and costs.

Horse Owner Responsibility

The Boarder acknowledges and agrees that

Horses are unpredictable animals.

The Ranch is not an insurer of the horse's safety.

Starlight Equestrian Ranch Inc, shall not be responsible for injury, illness, theft, escape, death, sickness, colic, disease, or loss of the horse unless caused by gross negligence or willful misconduct.

Property Damage

Boarder shall be responsible for any damage caused by the Boarder's horse, guests, family members, or invitees.

The Ranch may charge the Boarder for repair or replacement costs.

Termination

Either party may terminate this Agreement upon thirty (30) days written notice.

The Ranch may immediately terminate this Agreement if:

Fees remain unpaid.

The horse becomes dangerous.

The Boarder violates Ranch rules.

Continued boarding poses a safety risk.

All outstanding balances shall become immediately due upon termination.

Governing Law

This Agreement shall be governed by the laws of the State of California.

Venue for any legal proceeding shall be in San Bernardino County, California.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, and agreements.

Any modification must be in writing and signed by both parties.

Acknowledgment

I Have Carefully Read this Agreement, Release of Liability, and Assumption of Risk. I Fully Understand Its Terms and Sign It Voluntarily.Assumption of Risk

The Boarder understands and acknowledges that horseback riding, horse handling, horse boarding, trail riding, ranch activities, livestock activities, equestrian events, and related activities involve inherent risks that cannot be eliminated regardless of the care taken by the Starlight Equestrian Ranch Inc.

These risks include, but are not limited to:

  • Falls from horses
  • Kicks, bites, scratches, and crushing injuries
  • Horse behavior that may result in injury
  • Sudden movements, bucking, rearing, bolting, or spooking
  • Uneven terrain
  • Wildlife encounters
  • Collisions with people, horses, livestock, vehicles, fences, gates, or natural obstacles
  • Weather-related hazards
  • Equipment failure
  • Acts or omissions of other participants
The Boarder voluntarily accepts and assumes all risks of injury, illness, death, property damage, and financial loss arising from participation in any activity at or associated with the Starlight Equestrian Ranch Inc.
